The fleet manager for the Denver Police Department has been charged with menacing after an incident on a Commerce City, Colorado, roadway.
The Adams County District Attorney's Office filed the charge against Sgt. Jason Brake, a sworn officer who managed the department's fleet, in October 2024.
ABC 7 Denver reported that Brake allegedly pointed a weapon at a driver during a road rage incident.
What Led Up to Brake's Arrest
According to an arrest affidavit obtained by the news station, a man accused Brake of pointing a gun at him while the two were engaged in a road rage incident on Oct. 3.
One of the patrol officers who pulled Brake over removed a firearm from Brake while handcuffing him.
Brake told police the other man had pointed a gun at him, and he followed the truck until they were both pulled over.
The officer searched the other man's car but did not find a firearm or any other weapons, nor did they find any in the vicinity, according to the affidavit.
Brake admitted to officers that he moved into another lane while looking at his phone. The driver of another vehicle sped around him, and Brake said he then sped up to pass a semi truck to move into the right lane for the other driver.
As they drove next to each other, Brake said the other driver pointed a gun or some other object at him. He then allegedly yelled for the man to pull over to get a photo of him.
The man reportedly pulled over briefly, but got back onto the roadway, with Brake following him.
The two vehicles then pulled over down the road. Brake told responding officers that he did not remove his firearm from his holster, but the other man described exactly what the firearm looked like to police, according to the affidavit.
The man admitted to police he was driving aggressively, and said he pulled up alongside Brake with the intention of flipping him off, but said Brake rolled his window down and pointed a gun at him.
The man said Brake was following him very closely, prompting him to call 911. The man said he did not have a gun himself.
Brake was initially placed on paid administrative leave after the incident, a department spokesperson told Government Fleet.
Due to the felony charge, he is now in a non-paid administrative leave.
The Denver Police Department’s administrative review will begin once the criminal case is adjudicated, according to a department news release.
Brake joined the department in 1990 and was most recently assigned to the Operations Support Section, managing the fleet.
