Kansas has filed a legal challenge asking a federal appeals court to reject new Environmental Protection Agency (EPA) regulations mandating states to adopt conclusions about ethanol emissions, stating that the regulations are based on scientifically flawed methodology.
The state's Attorney General Derek Schmidt filed the suit in the D.C. Circuit Court of Appeals, his office has announced. The suit requests that the court prevent implementation of the EPA regulations, which would require states to use the 2014 edition of the EPA’s Motor Vehicle Emissions Simulator (MOVES) model for keeping pollutants under control according to national air quality standards.
By implementing its regulations without giving states and other affected parties the opportunity for review and comment, the EPA “forces states to measure emissions from ethanol-blended fuels in a way that incorrectly predicts higher levels of pollution,” according to Schmidt’s office.
